Terms of Service

Welcome to SocialSync Flow. These Terms of Service ("Terms") govern your access to and use of our websites, digital products, online courses, and community, all operated by Jds Socialsync SL ("SocialSync Flow," "we," "us," or "our"), a company registered in Spain.
These Terms specifically apply to:
- The 90-Day Growth Engine – our Instagram growth course
- The Social Suite – our membership community hosted on Circle
- Our digital guides, workbooks, templates, and other downloadable resources (including free lead magnets like the Hooks Toolkit)
- Our websites, landing pages, email communications, and discovery calls
By purchasing, accessing, or using any of the above, you agree to be bound by these Terms. If you do not agree, please do not use our services.
Please read these Terms together with our Privacy Policy, which explains how we handle your personal data.
1. About Us
These Terms form a legally binding agreement between you and:

2. Eligibility
To purchase our products or join our community, you must:
- Be at least 18 years old
- Have the legal capacity to enter into a binding contract
- Provide accurate and complete information during purchase and registration
- Use our services for lawful purposes only
If you are purchasing on behalf of a business, you confirm you have the authority to bind that business to these Terms.
3. Our Products & Services
3.1 The 90-Day Growth Engine
The 90-Day Growth Engine is a self-paced online course designed to teach Instagram growth strategy. When you purchase the course, you receive:
- Access to all 8 modules and their associated lessons, videos, and resources
- Access to any bonus content included at the time of purchase
- Lifetime access to the version of the course you purchased, subject to Section 14
Course content is delivered digitally. We do not provide physical materials.
3.2 The Social Suite (Membership)
The Social Suite is a paid membership community hosted on Circle.so. Your membership gives you:
- Access to the private community space and its channels
- Access to member-only content, resources, and events as described on the sales page at the time of your purchase
- Participation rights in community discussions, subject to the Community Guidelines in Section 8
Membership is billed on a recurring basis (monthly or annually, depending on the plan you choose) until cancelled. See Section 6 for billing and cancellation terms.
3.3 Digital Guides, Templates & Free Downloads
We offer digital guides, workbooks, templates, and similar downloadable products, including free lead magnets such as the Hooks Toolkit. When you access one of these products:
- You receive a non-exclusive, non-transferable licence to use the materials for your personal or internal business use
- You receive immediate digital access via download link or member area
- No physical product will be shipped
3.4 Agency Services
These Terms cover our digital products and community only. Our done-for-you social media management services (Sustain, Growth, and Scale packages) are governed by a separate service agreement signed between SocialSync Flow and the client.
4. Purchases & Payment
All prices are listed in the currency shown at checkout and, where applicable, include VAT at the rate required by law for your location.
- Payment is processed securely through our payment partners (including Stripe and Circle)
- By completing a purchase, you authorise us to charge the payment method you provide
- For subscriptions, you authorise us to charge the applicable fee on each renewal date until you cancel
- If a payment fails, we may suspend your access until payment is successfully processed
- You are responsible for any taxes, duties, or fees not collected by us at checkout
We reserve the right to change our prices at any time. Price changes will not affect purchases already made. For subscriptions, we will give you reasonable notice before any price change takes effect, and you may cancel before the new price applies. If you remain a continuous member, your locked-in rate will not change even if our public pricing increases.
5. Refunds & Cancellations
5.1 No-Refund Policy
All sales are final. We operate a strict no-refund policy on all our digital products, courses, memberships, guides, templates, and downloads. By completing a purchase, you acknowledge and accept that you are not entitled to a refund under any circumstances, except where required by mandatory law in your jurisdiction.
5.2 EU Right of Withdrawal & Digital Content
Under EU consumer protection law, consumers ordinarily have 14 days to withdraw from a distance contract. However, for digital content supplied immediately after purchase, this right is waived once you access the content and have given your express consent to immediate delivery.
By checking the relevant box at checkout and beginning to access the course, membership, or download, you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal once access begins.
5.3 Social Suite Cancellations
You can cancel your Social Suite membership at any time from inside your account or by contacting us.
- Cancellations take effect at the end of your current billing period
- You retain access to the community until the end of the period you have already paid for
- We do not provide refunds, including pro-rated refunds, for any partial or unused billing periods
- Annual memberships are non-refundable
- Cancelling permanently forfeits your locked-in rate. If you rejoin later, you will be charged at the then-current price
5.4 Digital Guides, Courses & Downloads
The Growth Accelerator, the 90-Day Growth Engine, the Viral Carousel Blueprint, and any other digital guide, course, template, or downloadable product are non-refundable. Access to these products is granted immediately upon purchase, and your right of withdrawal is waived as set out in Section 5.2.
5.5 Chargebacks
If you have an issue with a purchase, please contact us first. Initiating a chargeback without first attempting to resolve the issue with us may result in immediate termination of your access to all our products and communities, and we reserve the right to dispute any unwarranted chargebacks.
6. Your Account & Access
When you purchase a product, you will receive login credentials for the relevant platform (course portal, Circle community, etc.). You agree to:
- Keep your login credentials confidential and secure
- Not share your access with anyone else
- Notify us immediately if you suspect unauthorised access to your account
- Be responsible for all activity that occurs under your account
Access is personal and non-transferable. One purchase = one user. Sharing logins is grounds for immediate termination without refund.
7. Intellectual Property
7.1 Our Content
All course materials, guides, templates, videos, written content, graphics, frameworks, methodologies, and other materials we provide are the intellectual property of Jds Socialsync SL or our licensors. They are protected by copyright, trademark, and other applicable laws.
7.2 Your Licence
When you purchase a product, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the materials for your personal or internal business use. You may not:
- Copy, reproduce, or redistribute any course content, community posts, or downloadable materials
- Share your login credentials with anyone else
- Record, screenshot, or screen-capture course videos or live sessions for redistribution
- Resell, sublicense, or commercially exploit any of our content
- Use our content to train AI or machine learning systems
- Translate, modify, or create derivative works based on our materials
- Present our frameworks or teachings as your own
Templates and swipe files specifically marked as "for use with clients" or similar may be used in your own business with clients, but you may not resell or redistribute the templates themselves.
7.3 Your Content
Anything you post inside the Social Suite, submit in the course, or share with us (including testimonials, comments, and feedback) remains yours. However, by posting or submitting content, you grant us a worldwide, royalty-free, non-exclusive licence to use, display, and reproduce it for the purpose of operating the community and, where you have given explicit consent, in marketing materials.
7.4 Testimonials & Case Studies
If you voluntarily share your results, screenshots, or feedback with us, you agree we may use them in marketing (with your first name or a pseudonym), unless you tell us otherwise in writing. We will not use your full name, business name, or identifying images without your express consent.
8. Community Guidelines (Social Suite)
The Social Suite is a private, paid community. Membership is a privilege, not a right. To keep the space safe, useful, and on-brand, all members agree to:
- Be respectful, constructive, and kind in all interactions
- Keep discussions on-topic and relevant to the community's purpose
- Not use the community for cold outreach, spam, or self-promotion outside of designated spaces
- Not share other members' personal information, messages, or content outside the community
- Not post content that is discriminatory, harassing, defamatory, sexually explicit, or illegal
- Not attempt to poach clients, members, or team members through the community
- Not share affiliate links, pyramid schemes, or MLM promotions
- Follow any additional rules posted inside the community
We reserve the right to remove any content, suspend access, or terminate membership (without refund) for any violation of these guidelines, at our sole discretion.
9. Results & No Guarantees
Our products are designed to teach strategies that have worked for us and our students. However:
- We do not guarantee any specific results, income, follower growth, or business outcomes
- Your results depend on your effort, consistency, existing audience, niche, market, and many factors outside our control
- Testimonials and case studies represent individual experiences and are not typical
- Nothing in our content constitutes legal, financial, tax, or professional advice
You are solely responsible for your own business decisions and their outcomes.
10. Acceptable Use
You agree not to:
- Use our services for any unlawful, fraudulent, or harmful purpose
- Interfere with or disrupt the operation of our websites, platforms, or community
- Attempt to gain unauthorised access to any account, system, or data
- Upload viruses, malware, or any other malicious code
- Scrape, harvest, or extract data from our platforms without permission
- Impersonate any person or misrepresent your affiliation
- Violate any applicable law, regulation, or third-party rights
11. Third-Party Platforms & Links
Our services depend on third-party platforms including Circle.so (community hosting and payments), Stripe (payments), Flodesk (email), and our course hosting platform. Your use of those platforms is also subject to their own terms and policies.
Our websites and content may contain links to third-party websites or resources. We are not responsible for the content, accuracy, or practices of any third-party site and do not endorse them by linking to them.
12. Disclaimers
To the fullest extent permitted by applicable law, our services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that our services will be uninterrupted, error-free, or free of viruses or harmful components. Temporary downtime, maintenance, or platform issues are a normal part of operating digital services and do not entitle you to a refund.
Nothing in these Terms limits any rights you have as a consumer under Spanish or EU law that cannot be lawfully excluded.
13. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, consequential, or punitive damages
- We are not liable for lost profits, lost revenue, lost data, or business interruption
- Our total liability for any claim arising out of or relating to these Terms or our services will not exceed the amount you paid us in the 12 months immediately before the event giving rise to the claim
Nothing in these Terms excludes liability for fraud, gross negligence, or any other liability that cannot be excluded under applicable law.
14. Termination
We may suspend or terminate your access to any of our products or the community, with or without notice, if:
- You breach these Terms or our Community Guidelines
- You fail to pay any fees when due
- You initiate a chargeback without first contacting us
- You engage in behaviour that we reasonably believe is harmful to us, our team, or other members
- We are required to do so by law
In the unlikely event we discontinue a product entirely, we will give you reasonable notice and, for annual or lifetime purchases, a pro-rated or equivalent refund where appropriate.
"Lifetime access" means access for as long as SocialSync Flow continues to offer the relevant product. It does not guarantee access forever, and it does not survive termination for breach of these Terms.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our products, practices, or legal requirements. When we make material changes, we will notify you by email or through a notice on our website or inside the community. The "Last updated" date above will always reflect the latest revision.
Your continued use of our services after changes take effect constitutes acceptance of the updated Terms.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of Spain, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or our services will be subject to the exclusive jurisdiction of the courts of Marbella, Spain, unless mandatory consumer protection laws in your country of residence give you the right to bring proceedings in your local courts.
Before initiating any formal proceedings, we encourage you to contact us directly so we can try to resolve the issue amicably.
EU consumers also have access to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
17. General Provisions
- Entire agreement: These Terms, together with our Privacy Policy and any sales page-specific terms, make up the entire agreement between you and us
- Severability: If any provision is found unenforceable, the remaining provisions will remain in full force
- No waiver: Our failure to enforce any right or provision is not a waiver of that right
- Assignment: You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets
- Force majeure: We are not liable for any failure to perform caused by events beyond our reasonable control
